Most of our instructions come from trust companies acting as a trustee of an Isle of Man trust, but we also act for beneficiaries, settlors and protectors of trusts. We have advised and represented trustees on most issues including: the impact of foreign Freezing Orders; the impact of Manx Court Orders made under the Proceeds of Crime Act; the effect of foreign Confiscation Order; trustees being sued by the liquidator of an English company; consideration of sham trusts and constructive trusteeship; trusts and foreign divorces; resolving disputes between trustees and beneficiaries; and applying to Court for directions.
We also have experience in dealing with estates matters and have been instructed by executors, personal representatives and individuals claiming against an estate. Our advocates regularly give advice on complex and cross-jurisdictional issues including: will and legacy disputes, family provision claims (proceedings under the Inheritance (Provision for Family & Dependants) Act 1982), disputed Power of Attorney matters and disputes regarding the administration of estates including claims against executors and trustees.
